SPECIAL POLICY WITH REGARD TO INFORMATION FROM CHILDREN UNDER THIRTEEN

Camp S.W.A.G. takes children’s privacy very seriously and follows all COPPA guidelines to ensure that no personal data of minors under 13 is collected, stored, or shared without verified parental authorization. We encourage parents and guardians to actively monitor and participate in their child’s online activities related to Camp S.W.A.G.

In accordance with the Federal Children’s Online Privacy Protection Act of 1998 (COPPA), Camp S.W.A.G. does not knowingly collect personal information from children under the age of 13 without verified parental consent. If we become aware that we have inadvertently collected personal information from a child under 13 without verified parental consent, we will delete that information promptly.

When we do receive information from users under the age of 13 with verified parental consent, we will use that information only for the purpose for which it was collected and will not share it with third parties except as permitted by law.

Parents or guardians who have provided consent may review their child’s personal information, request its deletion, or withdraw consent at any time by contacting us at Admin@cswag.org.

1. Acceptance of Terms

The following Terms of Use and Terms & Conditions (“Terms”) govern all access to and use of the cswag.org website and all content, services, programs, events, and products offered by Camp S.W.A.G. (Students With Ambitions & Goals), including but not limited to Youth Leadership Foundation, STEM‑X Discovery Lab, Camp S.W.A.G. Group Mentoring Program, and Leadership Ambassador Program (collectively, the “Organization”).

The website and all related services are owned and operated by Camp S.W.A.G. (“Camp S.W.A.G.,” “we,” “us,” or “our”).

By accessing, browsing, registering for programs, enrolling a participant, submitting information, or purchasing any product or service through the website or affiliated platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as all related policies incorporated by reference, including but not limited to:

These Terms apply to:

  • Parents and legal guardians
  • Youth participants
  • Website visitors
  • Purchasers of products or services

Camp S.W.A.G. reserves the right to update or modify these Terms at any time. Continued use of the website or participation in programs after changes are posted constitutes acceptance of the revised Terms.

2. ELIGIBILITY AND AGE REQUIREMENTS

The Camp S.W.A.G. website and online services are intended for use by individuals who are at least thirteen (13) years of age, or by younger participants with verified parental or legal guardian consent, in accordance with applicable law.

Children under the age of thirteen (13) may not submit personal information through the website or participate in online services without verified parental consent. By accessing or using the website, you represent and warrant that you meet these age requirements or that you are a parent or legal guardian providing consent on behalf of a minor.

If you are a parent or legal guardian enrolling a minor or granting consent for a child under the age of thirteen (13), you agree that:

  • You have full legal authority to act on behalf of the minor
  • You consent to the minor’s participation in Camp S.W.A.G. programs and activities
  • You are responsible for supervising the minor’s use of the website and services
  • All information submitted on behalf of the minor is accurate, appropriate, and compliant with these Terms

Parents and legal guardians acknowledge that they are financially responsible for all fees, charges, and obligations associated with a minor’s enrollment and participation, and that consent granted under these Terms applies to all related programs, services, and communications unless withdrawn in writing.

Camp S.W.A.G. reserves the right to request verification of parental or guardian authority at any time and to deny or terminate access or participation if such verification is not provided.

3. CHILDREN’S PRIVACY & COPPA COMPLIANCE

Camp S.W.A.G. takes children’s privacy seriously and complies fully with the Children’s Online Privacy Protection Act of 1998 (COPPA) and all applicable privacy laws.

Camp S.W.A.G. does not knowingly collect, use, or disclose personal information from children under the age of thirteen (13) without verified parental or legal guardian consent. If Camp S.W.A.G. becomes aware that personal information has been collected from a child under thirteen (13) without such consent, that information will be deleted promptly.

When verified parental consent is obtained, personal information collected from children under thirteen (13) will be:

  • Used solely for educational, leadership, and program‑related purposes
  • Limited to what is reasonably necessary to support participation
  • Not sold, rented, or traded to third parties
  • Shared only as permitted or required by law

Parents or legal guardians who have provided consent may:

  • Review their child’s personal information
  • Request correction or deletion of such information
  • Withdraw consent at any time

Requests related to children’s personal information may be submitted by contacting Admin@cswag.org. Withdrawal of consent may result in the child’s inability to continue participation in certain programs or services.

4. PROGRAM PARTICIPATION

Camp S.W.A.G. provides educational, leadership, and community‑based programs designed to support youth development, personal growth, and skill building.

Participation in Camp S.W.A.G. programs may require parental or legal guardian consent, particularly where minors are involved or where limited personal information is necessary to facilitate participation.

Camp S.W.A.G. collects only the information reasonably required to:

  • Administer programs and activities
  • Communicate with participants and families
  • Support participant safety and program effectiveness

Participation in any Camp S.W.A.G. program is subject to compliance with all applicable policies, guidelines, and behavioral expectations communicated at the time of enrollment or participation.

Camp S.W.A.G. reserves the right to modify, suspend, or discontinue any program, activity, or component thereof as necessary to support program integrity, safety, or operational needs.

5. YOUTH PARTICIPATION, SAFETY & ASSUMPTION OF RISK

Participation in Camp S.W.A.G., Youth Leadership Foundation, Camp S.W.A.G. Group Mentoring Program, Camp S.W.A.G. Leadership Ambassador Program and STEM‑X Discovery Lab programs involves educational, recreational, leadership, and group‑based activities that may carry inherent risks, including but not limited to physical activity, collaborative projects, interaction with other participants, and the use of program materials or equipment.

By enrolling a minor in any Camp S.W.A.G. program, parents and legal guardians acknowledge and agree that:

  • Participation is voluntary and undertaken at their discretion
  • Certain risks are inherent in youth programs and cannot be entirely eliminated
  • Camp S.W.A.G. cannot guarantee the absolute safety of participants at all times

Parents and guardians understand and accept that Camp S.W.A.G. is not responsible for injuries, accidents, or losses that occur during participation unless such harm is the direct result of gross negligence or willful misconduct by Camp S.W.A.G.

Parents and legal guardians further agree that they are responsible for:

  • Ensuring their child is physically, emotionally, and behaviorally prepared to participate
  • Disclosing any medical conditions, allergies, behavioral concerns, or special needs prior to participation
  • Reinforcing program rules and expectations with their child
  • The conduct and actions of their child during all program activities

Camp S.W.A.G. reserves the right to take reasonable actions necessary to maintain the safety, well‑being, and integrity of its programs, including the removal of a participant whose behavior poses a risk to themselves or others. Removal for safety or behavioral reasons does not entitle the participant to a refund or credit.

5. PARENTAL CONSENT PROCEDURE

Before collecting any personal information from a child under the age of thirteen (13), Camp S.W.A.G. requires verified parental or legal guardian consent in accordance with the Children’s Online Privacy Protection Act (COPPA).

Verification of parental consent may be obtained through one or more of the following methods:

  • A signed parental consent form returned via email
  • Online verification using a parent or guardian’s contact information
  • Other reliable verification methods permitted under applicable COPPA guidelines

Camp S.W.A.G. reserves the right to determine the appropriate method of verification based on the nature of the information collected and the program involved.

To ensure ongoing compliance, Camp S.W.A.G. may periodically re‑verify parental or guardian consent and may contact parents or guardians to:

  • Confirm continued participation
  • Provide updates regarding their child’s involvement in programs
  • Request updated information or renewed authorization when necessary

Failure to provide or maintain verified parental consent may result in limited access to services or removal from program participation.

6. BEHAVIOR EXPECTATIONS, DISCIPLINE & REMOVAL AUTHORITY

All participants are expected to conduct themselves in a manner that supports a safe, respectful, and productive learning environment. This includes following program rules, respecting staff and fellow participants, and complying with all instructions provided during program activities.

Camp S.W.A.G. reserves the right to address inappropriate, disruptive, unsafe, or non‑compliant behavior using reasonable disciplinary measures, which may include verbal warnings, temporary removal from activities, or permanent removal from the program.

Parents and legal guardians acknowledge and agree that:

  • Behavioral expectations apply at all times during program activities, events, and communications
  • Camp S.W.A.G. staff have full authority to make immediate decisions necessary to protect participant safety and program integrity

Camp S.W.A.G. may remove a participant whose behavior poses a risk to themselves or others, disrupts the program environment, or violates organizational policies. Removal for behavioral or safety reasons does not entitle the participant to a refund, credit, or future program placement.

7. MEDICAL EMERGENCIES & EMERGENCY CARE AUTHORIZATION

Parents and legal guardians acknowledge that Camp S.W.A.G. staff are not medical professionals and that participation in programs may involve situations requiring emergency medical attention.

By enrolling a minor in any Camp S.W.A.G. program, parents and legal guardians authorize Camp S.W.A.G. and its staff to contact emergency services (including calling 911) and to seek emergency medical treatment for their child if, in the reasonable judgment of staff, such action is necessary and the parent or guardian cannot be reached in a timely manner.

Parents and guardians agree that:

  • They are responsible for providing accurate and up‑to‑date medical information, including allergies, medications, and relevant health conditions
  • Camp S.W.A.G. is not responsible for medical decisions made by licensed healthcare providers
  • All costs associated with emergency medical care are the responsibility of the parent or legal guardian

Camp S.W.A.G. will make reasonable efforts to notify parents or guardians as soon as practicable in the event of a medical emergency.

8. NONCOMMERCIAL USE OF INFORMATION

Camp S.W.A.G. does not sell, trade, rent, license, or otherwise commercially distribute any personal information belonging to youth participants or their parents or legal guardians.

Any personal information collected by Camp S.W.A.G. is used solely for legitimate organizational purposes, including but not limited to:

  • Educational programming
  • Leadership development initiatives
  • Program administration, coordination, and communication

Information is collected only to the extent reasonably necessary to support participation in Camp S.W.A.G. programs, ensure participant safety, and facilitate effective communication with families.

All personal information is handled in accordance with applicable privacy laws, including child privacy protections, and in compliance with Camp S.W.A.G.’s Privacy Policy and internal data‑handling practices. Camp S.W.A.G. does not use participant or parent information for advertising, marketing, or third‑party promotional purposes.

9. MEDIA RELEASE & USE OF LIKENESS

Camp S.W.A.G. may photograph, video record, or otherwise capture images or audio of participants during program activities, events, or sessions for educational, promotional, and documentation purposes.

By enrolling a minor in any Camp S.W.A.G. program, parents and legal guardians grant Camp S.W.A.G. permission to use their child’s name, image, likeness, voice, and/or work product in photographs, video recordings, digital media, or other materials for lawful organizational purposes, including but not limited to:

  • Program promotion and outreach
  • Educational materials and reports
  • Website, social media, and marketing content

Such materials may be used without compensation and may be edited, reproduced, or distributed in various formats, provided that use is consistent with Camp S.W.A.G.’s mission and values.

Camp S.W.A.G. will not knowingly use participant images or recordings in a manner that is misleading, inappropriate, or harmful. Parents or guardians who wish to limit or revoke media permissions must submit a written request prior to participation; however, Camp S.W.A.G. cannot guarantee exclusion from all incidental or group media capture.

Parents or legal guardians who do not agree to the media release described above must submit a written request the Admin@cswag.org prior to the start of program participation. Camp S.W.A.G. will make reasonable efforts to honor such requests; however, due to the nature of group activities and events, complete exclusion from all photographs, video recordings, or incidental media capture cannot be guaranteed. Refusal to grant media consent does not exempt participants from program activities and does not entitle families to refunds, credits, or special accommodations beyond reasonable efforts. 10. PAYMENTS, FEES, CANCELLATIONS & REFUND POLICY REFERENCE

By enrolling a participant in any Camp S.W.A.G. program, parents or legal guardians agree to pay all applicable program fees in accordance with the payment schedule and terms provided at the time of enrollment.

All cancellations, withdrawals, refunds, credits, and payment‑related matters are governed exclusively by the Camp S.W.A.G. Refund Policy available at (https://cswag.org/refund-policy/) which is published separately and incorporated by reference into these Program Terms & Conditions.

Parents and guardians acknowledge and agree that:

  • Administrative and registration fees are non‑refundable
  • Refund eligibility, deadlines, credits, and exclusions are determined solely by the Refund & Credit Policy
  • Failure to attend, partial participation, withdrawal, dismissal, illness, or schedule conflicts do not entitle participants to refunds or credits except as expressly stated in the Refund & Credit Policy
  • Initiating a chargeback or payment dispute after agreeing to the Refund & Credit Policy constitutes a violation of program terms

Camp S.W.A.G. reserves the right to enforce payment obligations and collect outstanding balances in accordance with enrollment agreements and applicable policies.

12. MODIFICATIONS, FINAL AUTHORITY & NON-PRECEDENT

Camp S.W.A.G. reserves the right to update, modify, or revise these Program Terms & Conditions at any time to ensure operational integrity, legal compliance, and program sustainability. Updated terms will be posted on the Camp S.W.A.G. website and will apply to future enrollments and, where applicable, ongoing participation.

Decisions made by Camp S.W.A.G. leadership regarding program participation, discipline, refunds, credits, scheduling, or policy enforcement are final. Any exception granted in a specific instance is made at the sole discretion of Camp S.W.A.G. and does not establish precedent or obligate Camp S.W.A.G. to grant similar exceptions in the future.

No verbal statements, informal communications, or prior practices shall modify or override these Program Terms & Conditions unless confirmed in writing by authorized Camp S.W.A.G. leadership.

13. California‑Specific Youth Protection & Consumer Rights Compliance

For participants, parents, or legal guardians residing in California, Camp S.W.A.G. acknowledges and complies with applicable California laws governing youth‑serving organizations, child safety, consumer protection, and privacy.

Without limiting the general applicability of these Program Terms & Conditions, Camp S.W.A.G. affirms that it maintains policies and practices consistent with California requirements, including but not limited to:

  • Assembly Bill 506 child abuse prevention requirements, including background checks, mandated reporter training, and written child abuse prevention policies for youth‑serving organizations
  • Child Abuse and Neglect Reporting Act (CANRA) obligations for reporting suspected abuse or neglect involving minors
  • Parental consent requirements for use of a minor’s name, image, or likeness under California Civil Code §3344
  • California consumer protection laws prohibiting unfair, deceptive, or misleading practices in enrollment terms, refunds, and program representations
  • Limitations on liability waivers involving minors under California Civil Code §1668, which restricts waivers of liability for gross negligence or willful misconduct

Nothing in these Program Terms & Conditions is intended to waive or limit any rights that cannot be waived under California law. Where California law provides greater protection to participants or families, those mandatory protections shall apply.

14. Non‑Discrimination Policy

Camp S.W.A.G. is committed to providing an inclusive, welcoming, and equitable environment for all participants, families, staff, and volunteers. Camp S.W.A.G. does not discriminate on the basis of race, color, national origin, sex, gender identity, gender expression, religion, age, sexual orientation, disability, medical condition, or family structure in the provision of services, programs, activities, or employment opportunities.

Any participant or parent/guardian who believes they have experienced discrimination or harassment based on any protected characteristic should report the concern to Camp S.W.A.G. staff immediately. All reports will be reviewed promptly, handled confidentially to the extent possible, and addressed in accordance with Camp S.W.A.G.’s policies and procedures. Retaliation against anyone who makes a good‑faith report is strictly prohibited.

15. MERCHANDISE TERMS

All Camp S.W.A.G. merchandise is made to order through our production partner.

Production & Shipping

  • Fulfillment typically takes 2–5 business days
  • U.S. shipping usually takes 3–7 business days after fulfillment
  • Shipping is free on all orders
  • Delivery times may vary during holidays or high‑volume seasons
  • Camp S.W.A.G. is not responsible for incorrect shipping addresses entered at checkout

Replacements

Replacements or credits are issued only for:

  • Misprinted, defective, or damaged items
  • Reported within 7 days of delivery
  • Accompanied by clear photos of the issue

All Sales Final

Because items are made to order, all merchandise sales are final. We do not offer returns, exchanges, or refunds for incorrect sizes, color preferences, or buyer’s remorse.

12. COMMUNICATIONS, NOTICES & CONTACT INFORMATION

Camp S.W.A.G. communicates with parents, legal guardians, and participants primarily through electronic means, including email, online platforms, and program‑related messaging systems.

By enrolling a participant in any Camp S.W.A.G. program, parents and legal guardians consent to receive communications related to:

  • Program updates and schedules
  • Enrollment confirmations and reminders
  • Policy notices and administrative information
  • Emergency or time‑sensitive notifications

Parents and guardians are responsible for providing accurate and current contact information and for regularly monitoring communications sent by Camp S.W.A.G. Failure to receive or review communications due to outdated contact information, spam filtering, or personal email settings does not relieve families of their obligations under these Program Terms & Conditions.

Official notices from Camp S.W.A.G. are considered delivered when sent to the most recent contact information provided by the parent or legal guardian.
